Terms of Service

1. About This Archive

Kornweiss Photography (“we,” “us,” “the Archive”) operates a community-driven historical photography archive at kornweissphotography.com. By using this site, you agree to these terms.

2. User Accounts

You may create an account to contribute photographs, stories, and identifications. You are responsible for maintaining the security of your account. We use magic link email authentication — no passwords are stored.

3. Contributor Agreement

By submitting a photograph, story, identification, or other content to the Archive, you represent and agree that:

  • You have the right to share this content, either because you own it, you have permission from the owner, or it is in the public domain.
  • You grant Kornweiss Photography a non-exclusive, royalty-free, worldwide license to display, reproduce, and share the content on the platform and in related materials (social media, newsletters, press).
  • You retain all ownership rights to your content. This license does not transfer ownership.
  • You may request removal of your content at any time by contacting us at contact@kornweissphotography.com. We will remove it within 30 days.
  • Your content will not be sold or sublicensed to third parties without your explicit permission.

4. Moderation

All submissions (photographs, stories, and identifications) are reviewed by our curator before appearing on the site. We reserve the right to decline or remove content that is inaccurate, inappropriate, offensive, or unrelated to the Archive's mission. We may edit submissions for clarity or formatting while preserving their meaning.

5. Historical Photographs and Copyright

The Kornweiss Photography archive contains historical photographs spanning from the 1890s to the present. Copyright status varies:

  • Photographs published before 1928 are in the public domain under U.S. copyright law.
  • Photographs from 1928 onward may be subject to copyright depending on their publication status and registration history.
  • High-resolution scans produced by the Archive are made available for personal, educational, and research use. Commercial use requires a license — see the “License This Image” link on individual photographs.

6. Identification of Living Persons

If you identify a person in a photograph who may still be living, or if you are a living person (or the representative of a living person) depicted in a photograph on this site, you may request that identifying information be removed or restricted. Contact us at contact@kornweissphotography.com.

7. DMCA and Takedown Requests

If you believe that content on this site infringes your copyright, please contact us at contact@kornweissphotography.com with a description of the copyrighted work, the URL of the infringing content, and your contact information. We will respond within 14 days.

8. Disclaimer

The Archive is provided “as is.” We make reasonable efforts to verify the accuracy of identifications and historical information, but we cannot guarantee the accuracy of community-contributed content. Identifications marked as “likely” or “uncertain” reflect the contributor's level of confidence and should not be treated as established fact.

9. Sensitivity and Respect

Many of the people depicted in this archive were members of immigrant Jewish communities. Some may have been victims of the Holocaust. We treat all photographs with respect and ask that community members do the same. Comments that speculate about sensitive personal details, or that are disrespectful to the subjects or their descendants, will be removed.

10. Changes to These Terms

We may update these terms from time to time. Significant changes will be noted on the site. Continued use of the site after changes are posted constitutes acceptance.
